TERMS AND CONDITIONS OF SALE – TAOE3

These Terms and Conditions of Sale (hereinafter the “T&Cs”) govern all sales concluded between TAOE3 and any natural person aged 18 or over or legal entity (hereinafter the “Customer”) placing an order via the website www.taoe3.fr (hereinafter the “Website”).
Placing an order implies full, unconditional and irrevocable acceptance of these T&Cs.

2. Products
The products offered for sale include handmade candles, jewelry and decorative accessories.
Due to their artisanal nature, slight variations in appearance, color or texture may occur. Such variations do not constitute a defect or non-conformity.
Product photographs and visuals are non-contractual.
3. Orders
Orders are considered final once payment has been validated.
TAOE3 reserves the right to refuse or cancel any order in case of:
▪ Previous dispute with the Customer
▪ Non-payment
▪ Suspected fraud
The Customer is responsible for the accuracy of the information provided when placing an order.
4. Prices
Prices are indicated in euros (€), including all applicable taxes (VAT included), excluding delivery costs.
TAOE3 reserves the right to modify prices at any time. The applicable price is the one in force at the time of order validation.
5. Payment
Payment is due in full at the time of ordering.
Payments are processed through secure payment service providers.
TAOE3 does not store full banking or credit card details.
6. Delivery
Products are delivered to the address provided by the Customer at the time of ordering.
Delivery times are provided for information purposes only.
6.1 Transfer of Risk
Risk transfers to the Customer when the Customer or a designated third party physically takes possession of the goods.
In case of damaged packages, the Customer must make detailed reservations with the carrier upon delivery.
7. Right of Withdrawal
In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has fourteen (14) days from receipt of the goods to exercise their right of withdrawal without providing any reason.
Returned products must be:
▪ Unused
▪ Complete
▪ In their original packaging
Return shipping costs are borne by the Customer. Download the Retractation form here.
Reimbursement will be made within a maximum of 14 days after receipt of the returned goods.
8. Legal Guarantees
The Customer benefits from:
▪ The legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code)
▪ The legal warranty against hidden defects (Articles 1641 et seq. of the French Civil Code)
9. Safety Instructions - Candles
Candles must be used strictly in accordance with the safety instructions provided on the packaging.
They must never be left unattended and must be kept out of reach of children.
TAOE3 shall not be held liable for damages resulting from improper or negligent use of its products.
10. Retention of Title
Products remain the exclusive property of TAOE3 until full payment of the price has been received.
11. Limitation of Liability
TAOE3 shall not be held liable for:
▪ Indirect damages
▪ Improper use of products
▪ Events beyond its control (force majeure)
Nothing in these T&Cs shall exclude or limit liability where such limitation is prohibited by law.
12. Force Majeure
TAOE3 shall not be liable for any delay or failure to perform due to force majeure events as defined under French law.
13. Consumer Mediation
In accordance with the provisions of the French Consumer Code relating to consumer dispute mediation, after having contacted us and in the absence of a satisfactory response, the Customer may refer the matter free of charge to:

14. European Online Dispute Resolution (ODR) Platform
In accordance with Regulation (EU) No 524/2013, Customers may also submit complaints via the European Online Dispute Resolution platform available at: https://ec.europa.eu/consumers/odr/
15. Personal Data
Personal data is processed in accordance with the Privacy Policy available on the Website.
16. Governing Law and Jurisdiction
These T&Cs are governed by French law.
In the event of a dispute, an amicable solution shall be sought first.
Failing amicable resolution, French courts shall have jurisdiction, subject to mandatory consumer protection rules.
17. Severability
If any provision of these T&Cs is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
By confirming an order, the Customer acknowledges having read and accepted these Terms and Conditions of Sale without reservation.
